MANDATORY REQUIREMENTS
ELIGIBILITY CRITERIA
International entrepreneurs must fulfill the following criteria:

  • Open an innovative project which will contribute positively to the Spanish economy;
  • Create more job places and investment opportunities;
  • Business must fit into Spain’s improved technology environment and its social-economic development.
After its expiration it is possible to switch to a 2-year residence permit which can be renewed every 2 years, provided the requirements are still met. A visa/permit holder may lose the residency status if more than 6 months out of any given 12-month period spent outside of Spain.

VISA PROCEDURE AND NECESSARY DOCUMENTS

Step 1. If outside Spain, request the report of Entrepreneur and submit a visa application at any Spanish consulate or embassy

1) Request the report of Entrepreneur at the Economic and Commercial office of the Spanish consulate or embassy or by the Directorate General for International Trade and Investments with the following documents:

  • Valid passport;

  • Health insurance;

  • Criminal record certificate from the countries where an applicant has resided in the last 5 years.

  • Bank statement (or other financial documents) demonstrating the existence of sufficient financial resources (in 2022, €579 per month and additional €290 for each dependent).

  • Professional profile of the applicant, their academic background, training and professional experience as well as their involvement in the project.

  • Business plan covering the following:
✓ Description of the project: business idea summary, business structure, start date, location, economic impact, potential of investment, number of jobs estimated, planned activities of promotion and sales strategy.
✓ Description of the product or service: consumer segmentation, value proposition, innovative aspect.
✓ Market analysis: supply/demand, main competitors, marketing strategies, geographic analysis.
✓ Execution and logistics: internal processes and operations necessary to function.
✓ Funding: investment required, funding sources and financial plan.
✓ Forecasted business results and profitability: a 3-year projection of the expected economic results (income and expenses).
✓ The added value for the Spanish economy, innovation and investment opportunities.

  • Request is processed within 20 days. Once your proposal is approved, you will receive a Report on the business project and may proceed with the visa application.

2) Book an appointment with the Consular office by email.

In the SUBJECT you must specify the type of visa you wish to apply for. The text of the message must include:

✓ Given name and surname;
✓ Passport number;
✓ Email address;
✓ Phone number;
✓ Place of residence;
✓ Type of visa you are applying for;

3) Apply for the visa with the following documents (translated and apostilled):


  • Valid passport. The passport must have a minimum validity period of 1 year and contain two blank pages.

  • Photo;

  • Criminal record certificate. This certificate cannot be older than 3 months, unless the certificate itself specifies a longer expiration.

  • Health insurance. Original and a copy of the certificate accrediting the public or private health insurance contracted with an insurance entity authorized to operate in Spain.

  • Favorable report on the business project. Original and a copy of the favorable report issued by the corresponding Economic and Commercial Office in this consular district.

  • Bank statement (or other financial documents) demonstrating the existence of sufficient financial resources (in 2022, €579 per month and additional €290 for each dependent).

Visa application is processed within 10 days.

Step 2. If in Spain, apply for the residence permit directly

1) Prepare the following documents for the entrepreneur residence permit at the Office of Large Companies and Strategic Economic Sectors (UGE-CE, La Unidad de Grandes Empresas y Colectivos Estratégicos):


  • Copy of the complete passport or travel document in force

  • (If applicable) Copy of the complete passport or travel document in force for applicant’s dependents

  • Bank statement (or other financial documents) demonstrating the existence of sufficient financial resources (in 2022, €579 per month and additional €290 for each dependent).

  • Health insurance. Original and a copy of the certificate accrediting the public or private health insurance contracted with an insurance entity authorized to operate in Spain.

  • (If in Spain for less than 6 months) Criminal record certificate. This certificate cannot be older than 3 months, unless the certificate itself specifies a longer expiration.

  • Proof of having fulfilled the legal requirements necessary to engage in the activity or, where appropriate, copies of the applications submitted (licenses, professional qualification or, where applicable, affiliation to professional associations, etc.)

  • Professional profile of the applicant, their academic background, training and professional experience as well as their involvement in the project.

  • Business plan covering the following:
✓ Description of the project: business idea summary, business structure, start date, location, economic impact, potential of investment, number of jobs estimated, planned activities of promotion and sales strategy.
✓ Description of the product or service: consumer segmentation, value proposition, innovative aspect.
✓ Market analysis: supply/demand, main competitors, marketing strategies, geographic analysis.

2) Request the report of Entrepreneur.

If you have a digital certificate (see info below), you can:

  • Send an application online through UGE-CE;


Without a digital certificate, you can:


  • Apply through any public registry office in your city. Your documentation will be digitized and sent internally to UGE-CE.

3) Await the decision:

Residence permit application is processed within 30 days. When approved, the permit will be valid for 2 years.


Step 3. Before you start your business activity

1) Get a taxpayer identification number (NIE), see info in the ‘When in Spain’ section.

2) Obtain digital certificate by applying online and providing the following information:

✓ NIE number;
✓ Name and surname;
✓ Email address;

You will receive an application code. Request an appointment with a Social Security office or a Tax Office and confirm your identity providing your ID and the code.

3) Get a social security number by applying in person at the General Treasury of the Social Security System with the following:

The application is processed within 45 days.

4) Register with the social security system:

You can register in person by going to a social security office, or electronically over the website, if you have a digital certificate.

5) Apply for a Foreigner Identity Card (TIE) with the following documents:

  • Application form (EX-17);
  • Photo;
  • Proof of registration with the social security system;
  • Proof of the card fee payment (varies from €15 to €22);

You will need to schedule an appointment and apply in person. Entrepreneurs on a visa are exempt from the TIE requirement until the visa expires.

Apply for the number (Número de Identidad de Extranjero, NIE) at a processing office of a local police station with the following documents:

  • Proof of identity (e.g., passport)
  • Spanish foreigner identification card (TIE) and number (NIE) 
  • Proof of address
  • Proof of employment status (such as Report of Entrepreneur)
  • Proof of sufficient financial resources

III. How to get medical insurance

  • To get access to public healthcare in Spain, you must register with the social security office (see info in the ‘Visa procedure and necessary documents’ section).



PERMANENT RESIDENCE AND CITIZENSHIP
Through this visa it is possible to obtain permanent residence in Spain. The additional requirements and documents are:

  • 5 years of residence
  • Application form (EX-11)
  • Passport and current residence permit
  • Proof of residence in Spain, such as a rental agreement
  • Proof that you have adequate income or financial resources
  • Medical certificate and health insurance
  • Proof of living in Spain for five years, such as payrolls or tax returns

After you have lived in Spain for 10 years, you can apply for citizenship. The additional requirements are:

  • DELE A2 (a Spanish language test) certificate
  • CCSE (a cultural exam) certificate
